Builder Sues Over Unfinished Senior Living Projects

A Sutherlin builder is suing the parent companies behind unfinished senior living projects in Roseburg and Creswell, claiming nearly $3 million in unpaid work. Dan Van Acker of Mars Construction alleges breach of contract and seeks foreclosure on the properties to recover costs.

A Douglas County construction company is taking legal action after claiming it was left unpaid for work on two senior living facilities that never opened.

Dan Van Acker, owner of Mars Construction in Sutherlin, has filed a lawsuit against Inspired Senior Living of Winery Lane Development, LLC, the company behind the Volante of Roseburg project. The assisted living facility had been expected to open this summer but remains incomplete. Van Acker says his firm is owed nearly $2.5 million for work performed.

In a separate case, Van Acker is also suing Inspired Senior Living of Creswell Development, LLC over a similar facility in Creswell, where he claims his company is owed about $571,000.

Both suits accuse the developers of breach of contract. Van Acker is also asking the courts to allow foreclosure on the two properties, each of which has construction liens filed against them, in order to recover the unpaid costs.
